The winning tenderer's legal interest in bringing an action before the Complaints Board for Public Procurement and the possibility to use the urgent producer in Section 57(5) of the Public Procurement Act

The decision is interesting, partly because the Complaints Board considers whether a tenderer can submit a complaint against a procedure that the tenderer has won - i.e. the limits of legal interest in such a case. Partly because this is a rare decision on the interpretation of Section 57(5) of the Complaints Board Act on the contracting entity's use of the urgent procedure - i.e. the contracting entity's right to shorten the deadline for submission of tenders from 30 to 15 days from the day after the contract notice was sent.
