Judgment of October 5, 2022 on product liability - duty to investigate, knowledge of the time, etc.

Recently, a judgment was given in a case where the supplier of a lubricating oil for hybrid buses, which as a result of a high sulphur content in the oil was exposed to engine failures, was acquitted of liability, as the court emphasized, among other things, that at the time when the supplier recommended the oil in question, there was only incipient focus on the problem in question. The injured party's view that the supplier should have investigated the technical conditions more closely before recommending the lubricating oil in question was not upheld, as the court emphasized, among other things, the information and material the supplier had received in connection with the request to propose an alternative to the oil prescribed by the manufacturer.
