Judgment of December 21, 2022 on liability for shipwreck

The Court of Greenland has recently ruled on a recourse case in which a hull insurer claimed reimbursement of damage costs in connection with a shipwreck from a workshop which, prior to the accident, had carried out major renovation work on the vessel. The insurer referred in particular to the report drawn up by the Maritime Accident Investigation Board, which assumed that the accident was caused by the workshop having removed a drainage hose and forgetting to reinstall it after the work had been completed. The trial concerned in particular the question of proof of liability for the accident, including the probative value of the accident investigation report
