Principal Supreme Court judgment of August 24, 2022 on direct claims for the purchase of construction materials by a contractor
In a fresh judgment of 24 August 2022, the Supreme Court has ruled that a contractor who had purchased and used building materials (MgO boards) that were not suitable for the purpose for which the boards were sold and marketed, including in the product sheet, did not have a direct claim against an earlier link in the turnover chain - a Danish wholesaler and importer of the MgO boards and the issuer of the product sheet.
